Re: VINACONEX CORPORATION has no connection with Vinaconex Infrastructure Development and Construction Investment JSC (Vinaconex 34)

Vietnam Construction and Import-Export Joint Stock Corporation (“VINACONEX Corporation”) would like to extend our warmest greetings to valued shareholders, partners, clients, and media agencies.

Recently, several online media outlets have published information regarding Vinaconex Infrastructure Development and Construction Investment JSC (“Vinaconex 34”), accompanied by images of VINACONEX’s headquarters. This has led to misunderstandings and public confusion about the relationship between the two entities.

We hereby clarify the following:

In line with the Board of Directors’ strategy to restructure underperforming subsidiaries and affiliates, VINACONEX Corporation divested its entire stake in Vinaconex 34 as early as 2012. Since then, Vinaconex 34 has not been a subsidiary or affiliate of VINACONEX Corporation, and there have been no financial, personnel, management, or operational ties between the two companies.

Following the divestment, we has issued multiple formal requests for Vinaconex 34 to change its business name to remove the “VINACONEX” brand. Vinaconex 34 also formally committed to cease using the VINACONEX brand by December 31, 2022. However, despite repeated follow-up notices, Vinaconex 34 has failed to honor this commitment

The continued unauthorized use of the VINACONEX brand by Vinaconex 34 in its name and trading activities constitutes a serious infringement of legally protected industrial property rights, also misleading the public and negatively affecting the reputation and brand value of VINACONEX.

VINACONEX is currently pursuing legal procedures to safeguard our legitimate rights and interests, and at the same time requesting Vinaconex 34 to immediately cease all infringing activities and stop using the VINACONEX brand without authorization.

We also respectfully urge media agencies and press outlets to verify information carefully and refrain from publishing content and/or images of headquarters that may create confusion between VINACONEX and Vinaconex 34.
